Judge denies NFL's motions to dismiss Jon Gruden's lawsuit, move it to arbitration

A Nevada judge ruled in favor of former Las Vegas Raiders coach Jon Gruden on two motions Wednesday, opening the possibility of a jury trial on his "tortious interference" claim that the NFL and commissioner Roger Goodell selectively leaked Gruden's emails to force his removal on Oct. 11. Judge Nancy L. Allf denied the NFL's motion to compel arbitration as well as the league's motion to dismiss the case outright. The suit will now go to trial unless a settlement is reached. Allf gave no timeline, though, for the next proceeding.The NFL said in a statement given to multiple media outlets that it would appeal." We believe Coach Gruden's claims should have been compelled to arbitration, and we will file an appeal of the Court's determination. The Court's denial of our motion to dismiss is not a determination on the merits of Coach Gruden's lawsuit, which, as we have said from the outset, lacks a basis in law and fact and proceeds from a false premise -- neither the NFL nor the Commissioner leaked Coach Gruden's offensive emails."

Ex-Raider Warren Sapp Rips DeMaurice Smith Over Jon Gruden Controversy


The Las Vegas Raiders were hit with a bombshell during the 2021 season when The Wall Street Journal reported that head coach Jon Gruden had said that NFLPA executive director DeMaurice Smith “has lips the size of Michelin tires” in an email to former Washington Commanders team president Bruce Allen. Gruden quickly found himself in the center of controversy and his job status was immediately in question. Raiders owner Mark Davis let the process play out until The New York Times reported on more emails from the coach that contained homophobic and misogynistic language. In response to the original email, Smith said that the “email from Jon Gruden and some of the reaction to it – confirms that the fight against racism, racist tropes and intolerance is not over.” Gruden resigned the following week and he’s not received any interest from NFL teams since. Former Tampa Bay Buccaneers and Raiders defensive lineman Warren Sapp played two seasons under the coach and won a Super Bowl with him.

Jon Gruden loses bid for reconsideration in NFL lawsuit​

Jon Gruden lost a bid for the Nevada Supreme Court to reconsider whether a contract interference and conspiracy lawsuit he filed against the NFL after he resigned as coach of the Las Vegas Raiders should be heard in court or in private arbitration. Attorneys for Gruden, the league and an NFL spokesman didn't respond to messages after notice was posted Monday on a court website. It wasn't immediately clear whether Gruden can seek a hearing before all seven state Supreme Court justices. Gruden's lawyers sought the rehearing after a three-justice panel split in a May 14 decision that said the league can force the civil case out of state court and into arbitration that might be overseen by NFL Commissioner Roger Goodell. Gruden was the Raiders' head coach when the team moved in 2020 to Las Vegas from Oakland, California. He left the team in November 2021 with more than six seasons remaining on his record 10-year, $100 million contract. Gruden had previously coached in the NFL from 1990 to 2008, including stints in Oakland and with the Tampa Bay Buccaneers, whom he led to a Super Bowl title in 2003. He spent several years as a TV analyst for ESPN before being hired by the Raiders again in 2018.
