The Spamstitution

...I wanna change it. Suggestions are:

Spamstitution(revised):
We, the citizens of the Badlands, declare this Spamstitution law. These are the guidelines for the selection of the citizens and moderators within this forum.

1. There is a master list of those who are citizens ('Citizen's List) and this list may only be updated by missmanners or the current moderators.

3. New citizens may be added before the next election.
A) Only valid and current citizens may nominate another poster for citizenship.
B) Each citizen may only nominate one new citizen every other election.
C) Citizens added between elections have no vouchers to add other citizens until the completion of the current moderator election.
D) A minimum of three citizens may petition to overturn a nomination for a new citizen. The decision ('Citizenship Vote') will be made by the current moderators. The decision has to be made unanimously within one week. Any discussion between the moderators pertaining to the nomination of a new citizen has to be made in public. If after said week there is no consent reached, the nomination counts as overturned.
E) To be added as a new citizen you must have made a thread, or posted within the Badlands within a month before the announcement of each election.
F) Dual accounts (sockpuppets) may be nominated for citizenship.
G) Citizenship Votes will be held seven days prior to every second election.
H) Once a new citizen has been added to the official list of citizens, they can only be removed in adherence of the procedure as given in §5.

4. The citizens chosen in the latest election are to be grandfathered into the next election.

5. Those citizens who emigrate from the Badlands can be stricken from the list of grandfathered citizens[strike]by a majority yes/no vote.[/strike] The decision ('Emigration Vote') will be made by the current moderators. The decision has to be made unanimously within one week. Any discussion between the moderators pertaining to the emigration of a citizen has to be made in public. If after said week there is no consent reached, the nomination counts as overturned.
A) A citizen who has emigrated must not have posted within the Badlands for a period of one month.
B) A current citizen must nominate someone for being stricken from the Citizen's List ('Emigration').
C) Each citizen may only nominate one citizen to be stricken from the Citizen's List every other election.

The decision has to be made unanimously within one week. Any discussion between the moderators pertaining to the nomination of a new citizen has to be made in public. 6. There will be one permanent and two temporary Badlands Moderators at any given time.

7. The permanent moderator is appointed by missmanners. The term of office for the permanent moderator will be as long as missmanners dictates or until the person holding said office resigns.

8. The temporary moderators are being elected by the Badland's Citizens.
A)The current length of office is four months.
B) The terms of these Moderators will overlap by two months.

9. Nominations for moderator may be submitted in any form the citizen chooses.
A) Nominations should have proof. Claiming you PM'd missmanners or submitted your nomination via MSN chat is not sufficient.
a. Screencaps are valid proof.
B) Proof need not be furnished unless the citizens disagree with the elected official.
a. In order to officially disagree there must be a 2/3 majority of citizens who disagree with the election results.
C) The cutoff time for nominations is 48 hours prior to the election.
D) Only Badlands citizens may be nominated.
E) A person may refuse a nomination.

10. There will be at least a 14 day notice as to what day the election will be held.

11. The vote will be held over a 48 hour span.

12. The winner will be chosen by simple majority.

13. In the case of a tie, the two candidates with the least votes will be stricken from the ballot and there will be another election ('Secondary Election'). This election will be held immediately. Secondary elections will be held until there is a clear winner.

14. Secondary elections will last as long as the original.

15. The ballot itself will be a thread with a cutoff date.
A) The time zone used for this cutoff will be Eastern Standard Time (GMT -5).

16. There is no limit to how many times a person may hold the office.
A) Once a person has served one term, they must wait one full term before they may be reelected.

17. The Badlands moderators will dictate the policies and rules of the Badlands. In order to pass, change, or delete a policy or rule of the Badlands ('Change of Rules'), all three moderators have to publicly vote for/against said Change of Rules. The decision has to be made unanimously. If after one week, consent has not been reached, the Change of Rules counts as rejected.

18. Any moderator who moves a thread from this forum will be removed and can not be a moderator again

19. There shall be no rules made by the moderators or this Spamstitution that contradict the rules of Troll Kingdom.

20. We withhold the right to amend this Spamstitution at a later date, should the need arise.

21. If you don't like these rules, don't post here. We don't like you anyway.

22. In the case that any of these rules need arbitration, missmanners will be the arbiter. No exceptions.
 
Translation for those of you who have (or pretend to have) a life:

1. Citizen's list - still there, learn to deal with it.

2. You've been a citizen for over two months? Cool, you can make a new citizen every 4 months. Just say so in a thread. If three ppl don't like your new friend, the moderators will decide. Learn to deal with it.

3. There are ppl who haven't posted within a month before we get a new mod? If you've been a citizen for over 2 months, you can kick one of them out every 4 months. Just say so in a thread. If three ppl want the person to stay, the mods decide. Learn to deal with it.

4. Ily is dictator for life. Deal with it.

5. If you've been a citizen for over 2 months, you can nominate and elect a new mod every two months. If there's a tie, you may even get to vote again. And again. And again...

6. You'll be informed when the next election will be held. You have 2 days to cast your vote. If you're too lazy or dumb to vote, don't bitch about the results afterwards. Just learn to deal with it.

7. The mods decide what is cool or not cool in the Badlands, but we have to agree about it. Learn to deal with it, or just leave.

8. We can change this monster whenever we feel like it.

9. That's it, basically.
 
Interesting how you vote against any decision that might reduce your power.... coincidence?

And obviously, §7 is not clearly implied, judging from how many times my position has been questioned in the past months.
 
The new rules clearly clarify and settle all current legal woes pertaining to the Badlands bar the fact that Omar and/or Gonad [personally I say both] are illegal mods. Let's get these rules voted on by the Badlands citizenry and hold an emergency election to start with a fresh slate under them.

I would also add an amendment of §16 that shared accounts cannot hold office nor may a dual of the current or an outgoing mod run for election. The latter would help §16A not be completely redundant.

Problem I see with this is that it includes major dual outings, done either voluntarily (completely OK, but rather unlikely), or forced once, which we all know won't and shouldn't happen.

This time also, there should be no limit to the number of emigration votes by one citizen since we would still be operating under the original spamstitution

Yub, they are not illegal mods. Yes some people were added to the citezens list that should not have been there. But go back and look at the voting threads for these two. Its pretty unanamous that most wanted Gonad and Omar. I am the only one that had to vote herself in. Every election has been bitched about-and after I got bitched at for using all of my duals I stopped doing that-I think in the last elections I only voted once.
Anyway lose the fight on some of these things Yub its neither funny nor entertaining.
If you are entertained however by all means continue on.

They are illegal mods. The spamstitution only allowed for two mods ONE TIME. After the first election there should have only been one mod.

Clause 5 is just a mess, all around. In 3, you didn't limit the power of an individual mod, you increased it, as a single obstinate mod has the power to veto.

Who cares if they question 7? It's clear as day, they're just trolling or are truly oblivious.

17, again, requiring the unanimous consent of three mods is ridiculous. Clearly, in such a situation, you could constantly veto everything the elected majority, such as Omar and Gonad, tried to implement; the lack of this clause wouldn't serve to strengthen my hand, but it sure as hell increases your own power. Given this, it's pretty clear that this entire document is a thinly veiled power ploy on your part.

Oh and regarding the amendments...
I've changed my mind. Please disregard what I said upthread. The only amendment I would like to make and being voted on is the following:

17. The Badlands moderators may not dictate any policies or rules of the Badlands. Their sole power lies in the sticking and unsticking of threads if the thread starter agrees with it, the merging and unmerging of Floods (to be defined), the editing of posts that clearly go against TK rules, and the closing and opening of threads upon demand of the thread starter.

That should take care of any power struggles, doubts or other causes of fear the Badlands' posters might have regarding moderation.
