I've seen this strategy used before in real life. TPTB will herd you closer and closer into a smaller and smaller area until you have no wiggle room. All the time, the rules will be changed to suit their ultimate goal: declaw and defang the "trouble makers" and place them on permanent restriction. The ones who cry the loudest for more and more rule changes, harsher punishments, and send out the hue and cry for the perceived troublemakers to be expelled from the group were, at one time or another, considered problem children within the familly body. I don't know if this is classic projection or smug glee at having someone else be the family pariah instead of them. In any event, no one seems to understand that their home has changed and not necessarily for the better.
 
I know domestic law, municipal law, contract law, employment law. Couldn't just one of these freaking questions be about something I understand? Just one. I'm not asking for much. Just one freaking question that makes some freaking sense! But noooo - if you have two trees in an appertunance easement will the title company make the utility company move the power lines so you can build a swimming pool in your back yard? What if the will isn't in the cookie jar and the property is a life estate on which you put earnest money on and sold it to the baker to hang sugar coated donuts on the two trees in the easement?
 
Been there, done that. I know it's hard, and the failure percentage is high. Just don't give up, and don't get frustrated. Or else you'll get banned from AQG too! :D

No. The power company, as a government agency, has eminent domain rights over the area that the pole sits on. They just don't stick those things anywhere, but rather exactly where they need to be to get lines to every other house. The title company wouldn't want to push the matter.

Or at least, that's how I would argue it.

And if you sell it to the baker, then he owns it. Doesn't he?
 
Yeah, he may hate the Cow, but think about who was apopletic with rage, well I mean besides A Karas...that was a stellar performance piece by the way.
 
As much as I love fighting I hate what this is doing to EI. You can laugh at me and make fun of me for it all you want but EI is my home board and I truly love it.

I work for attorneys. My boss thinks I should be a paralegal. Funny thing, most of what they teach in these classes I was doing years ago in domestic law and I've been doing for years in municipal law. Except real estate law. I hate real estate law. I really, really, really, really do.

Nothing wrong with attorneys. I like them - most of the time - when they give me presents and a decent raise. Sometimes I hate them. Like now. In the morning I'm going to stick a tack in every one of my bosse's chairs. It will be clearly understood that the only thing that will placate me is a big refill on my movie pass card. They gave me one a couple of years ago so they can whip out their charge cards, make a phone call and refill the thing remotely, while it is in my purse, because when I need it filled it is best for them not to get tooooo close to me. I eat attorneys. They are crunchy and good with ketchup.

And, I'm going to need a day off to go watch movies. I'm thinking Friday while my car is in for warranty work.

Did I mention that I hate real estate law?

Now, that would be a riot. Actually, it would do me a favor. Then I wouldn't be tempted to read something vastly more interesting than freaking real estate law.

Not necessarily. The power company isn't a government agency. The easement can be taken by eminent domain by a gov't agency for use as a ROW for the utility. But, there can be easements created for other purposes besides utility and access - could create one to keep people from living in an unsafe area, or to protect flora and fauna. Generally, the ROW/utility easement would have been created in the subdivision plat. And, true, neither the title company nor the property owner might want to press the issue as they could lose the benefit of the utility. However, if a power line was buried under one's backyard, it wasn't listed in the deed records, and it was only discovered when the owners were installing a swimming pool, then the title policy company would have to pay for the damages (such as a worker slicing into that power line) and reimburse the property owners for their loss of value on the property. I'd be happy to sell it to the baker but I don't think I can as I think it remains attached to the servient estate.
