The purpose of this conference will be to reflect upon the traditional, 'classical' dilemmas and taxonomies in the philosophy of human rights, in the light of recent developments in theories of rights and in the international law of human rights. We all have been taught, and have taught, a number of traditional dichotomies that have been entrenched in theories of human rights for a number of decades: moral versus legal, positive versus negative, first-generation versus second- (and third- ) generation; vertical (against the state) versus horizontal (against other citizens); universal versus relative (or particular); judicially-enforced versus legislatively-protected, etc. Have these dichotomies retained their validity and only the circumstances of their practical applications been altered or have they outgrown their validity altogether?
There have been important developments in the philosophy of human rights and in the international law of human rights, both of which may shed a new light on the dilemmas encapsulated by these (and other) dichotomies.

Peace versus Justice: A False Dichotomy? Mapping Tensions and Complementarities between Conflict Resolution and Human Rights Advocacy in Afghanistan | Merkel | Journal of ConflictologyIn the aftermath of a conflict, peace and justice are often seen to be in direct tension. Demands for justice and legal accountability can be an obstacle to peace, since peace accords may involve compromises with war criminals and human rights perpetrators. The peace versus justice debate therefore translates into a conceptual struggle between conflict resolution and human rights advocacy. In Afghanistan, peace and conflict are often seen as inherently conflicting. Justice, it is often argued, must wait until security has been established. Rather than punishing the perpetrators of past war crimes, the Karzai government has accommodated some of the most notorious warlords, by appointing them to some government positions. While it was long thought that this would have a stabilizing effect, this paper argues that the policy of relying on Afghanistan's warlords-cum-politicians has failed to bring lasting security, peace and stability to the country. This paper presents a brief foray into the field of peace and transitional justice in a fragmented 21st century Afghanistan.
The Journal of Conflictology is an interdisciplinary and peer-reviewed open access journal on conflict resolution. Based on the conviction that non-violence is an effective means to wage conflict, it promotes non-violence both as a method of conflict resolution as well as a strategy of handling conflict.
The journal examines the application of conflict resolution theories and provides knowledge on the practice of non-violence through a realistic and scientific approach.
Contributions published at the journal share the results of original scientific research.
Edited at the Open University of Catalonia (UOC) in Barcelona by an international editorial board, Conflictology embraces a global focus on conflict and peace-making and aims to publish contributions which can be read by nonspecialists, academic experts and practitioners alike.
It encourages a wide conception of peace, while focusing on the ways and means of conflict resolution. As an interdisciplinary journal, Conflictology invites contributions from a broad range of traditions that address theories and practice of nonviolence, conflict resolution and peacebuilding; submissions may address theories of non-violence, theories regarding the development and transformation of conflicts, theories of practice, descriptions of the experience of practice, as well as the evaluation of practice. Articles can include policy briefings, review articles, comments and interviews.
